These terms govern your membership and use of the Pesa Ya Chama Welfare Group members' portal at pesayachama.com. By registering, you agree to them. Pesa Ya Chama is a registered welfare group (Reg. No. DSD/47/289/01/62560) under the Community Group Registration Act, No. 30 of 2022 — see Certificate of Registration, Certified Group By-laws, and Group KRA PIN Certificate.
Membership
Registration and approval are instant and automatic: once you submit a valid KRA PIN and National ID, we verify them against KRA's own registry and your membership activates immediately — there is no manual review step in the ordinary case. We may still decline, suspend, or terminate membership at our discretion, including for suspected fraud, provided false information, or violation of these terms.
Wallets and contributions
Your monthly contribution (per the Group Bylaws) is split across several wallets — Chama Savings, executive office tokens, tree-planting, and digital platform maintenance (which also covers AI Financial Advisor credits). Beyond your standard contribution, the platform tracks separate wallets for welfare/harambee support, guarantor and investor earnings, and pooled guarantee/invest capacity — each with its own withdrawal rules, shown on the Wallets page.
Loans, guarantees, and investing
The group offers a member-guaranteed group loan pool, access to an external bank-backed credit facility, and a community capital marketplace where members may invest their own available capacity to fund other members' loan requests and earn interest. Guaranteeing a loan is a real financial commitment: no single guarantor may cover more than 20% of any one loan — several guarantors together cover the full amount, and the total guaranteed always exactly matches the total invested, at every stage of the loan. If a borrower fails to repay for 45 days, the loan is declared in default: the guarantors' locked funds are used to repay the investors' principal in full, and guarantors forfeit both that amount and the interest they expected. Investing in a loan carries materially lower risk as a result — your principal is not at risk; only the interest you expected may be forfeited if a default occurs. Guarantors, by contrast, should only commit funds they can genuinely afford to lose. Interest rates, repayment terms, and guarantee/investment mechanics are as displayed on the platform at the time of each transaction, and your borrowing limits are set by your Community Credit Score, calculated from your own contribution and repayment history.
Withdrawals and fees
Withdrawals are paid out via Safaricom M-Pesa (Daraja B2C) to your registered phone number, and require your withdrawal PIN — a separate code you set in Settings — in addition to being signed in. A fee, matching Safaricom's actual published tariff for these payouts, is deducted from the amount sent; the current fee schedule is shown before you submit a withdrawal request. Some wallets (e.g. Chama Savings) are only withdrawable during a defined annual window, as set out in the Group Bylaws.
AI Financial Advisor
The optional AI Financial Advisor narrates your own account data back to you and offers general guidance — it is not professional financial, legal, or tax advice, and it cannot move money, create a loan, or change any balance on your behalf. Any recommendation it gives should be treated as a starting point, not a substitute for your own judgment. Use of this feature is subject to a fair-use credit limit described on the Wallets page.
Your membership card and public verification
Your digital membership card includes a QR code and a public verification link so that a third party (e.g. an employer or a bank) can confirm your name, membership number, status, and official seat (if any) at pesayachama.com/verify, without needing to log in. No financial information is disclosed through this lookup.
Your responsibilities
- Provide accurate, truthful information, including your identity documents and KRA PIN
- Keep your login credentials and withdrawal PIN confidential, and your payout details up to date
- Use the correction-request process in Settings if any of your details need fixing, rather than sharing account access with someone else to change them
- Use the platform only for legitimate personal or group financial activity
Financial risk
As with any savings or lending arrangement, your contributions, loans, guarantees, and investments carry real financial risk. The group takes reasonable care in operating the platform but does not guarantee returns, and is not liable for losses arising from a borrower's default, a technical failure at a third-party bank or payment provider, or circumstances outside our reasonable control.
Suspension and termination
We may suspend or terminate an account that violates these terms. You may leave the group at any time, subject to settling any outstanding loans, guarantee, or investment obligations first.
Changes to these terms
We may update these terms from time to time as the platform evolves. Continued use of the platform after an update means you accept the revised terms.
Governing law
These terms are governed by the laws of Kenya.
